Abstract

The Mental Healthcare Act, 2017 was enacted in India to protect the rights of persons with mental illness and to ensure access to quality mental healthcare services while upholding their dignity and autonomy. This article examines the objectives, provisions, and implementation of the Act, with particular emphasis on the role of Mental Health Review Boards in safeguarding patient rights. The Act introduces important rights-based mechanisms such as Advance Directives, Nominated Representatives, informed consent, capacity assessment, and protection against discrimination and inhumane treatment. It also establishes Mental Health Review Boards to oversee mental health establishments, address grievances, review admissions, and ensure compliance with legal and ethical standards. The article further discusses the distinction between Nominated Representatives and legal guardians, the rights of minors and women receiving mental healthcare, and the procedural safeguards available under Sections 89 and 90 of the Act. By comparing the Mental Healthcare Act, 2017 with the earlier Mental Health Act, 1987, the paper highlights the transition from a custodial approach to a rights-based framework. The study concludes that effective implementation of the Act, along with awareness among healthcare professionals, patients, caregivers, and legal authorities, is essential for promoting patient welfare, protecting human rights, and improving mental healthcare delivery in India.
